It’s important that any land offered for sale is checked to ensure it has planning permission in place and there are no outstanding debts attached to the property. In most cases the land registry (Registro de la Propriedad) will show this information. In Spain, any debt or mortgage on the land is transferred to the new owner. While in most cases this information will show on the land registry, it is not always the case. When land ownership has been for many, many years, the transference of accumulated debt such as a mortgage or outstanding property tax is not always transparent on the land registry.
Rural land (where development is not possible) is VAT exempt and subject to only the transfer tax, which varies from 8-10% depending on purchase price.
For land that is suitable for development, the purchase price is taxed at 21% VAT + 1.5% stamp duties.
Further to the above-mentioned taxes, the buyer will have to pay Notary fees, Land Registry fees (and lawyer fees if involved). In Spain the vendor usually pays the agent’s commission, and the buyer should check this in advance.
